But what happens if your company denies your claim? Are you out of luck and stuck with the financial hardship?

Who can deny your claim?

Your employer makes the first decision on your claim. Your benefits may be denied due to the following issues:

  • Didn’t submit your claim within Kentucky’s two year statute of limitations
  • Were injured outside of working hours
  • Failed to follow safety regulations
  • Had alcohol or drugs in your system

If you believe that your employer made a mistake in denying your claim, you can contest their decision in court.

There is still a chance to receive benefits

Once you appeal your denied claim, a judge makes the decision instead of your employer. Both you and your employer will present evidence and argue why you should or should not receive worker’s comp. Having the help of an experienced attorney may increase your chances of winning the appeal.

If the judge decides to deny your claim as well, you can appeal again to the Kentucky Worker’s Compensation Board. After that, you could appeal to a higher court if the board still sides with your employer.
